An accident at work is not just a technical or medical issue that your OHS department will take care of. There are many things associated with it that are primarily the responsibility of you – the HR manager – and that can bog down the HR department, especially with lengthy administration. In the event of an accident at work, a record is made in the accident book and the accident is then reported to a number of places. In addition, depending on the severity, it is often quite complicated to explain.
As the most serious work accidents are often linked to the question of entitlement to high financial compensation, it is not uncommon for these claims to become the subject of litigation. We will therefore look at how to proceed from the onset of an accident at work until its settlement: it is essential to be able not only to investigate the circumstances of the accident, but above all to assess when it is actually an occupational accident or disease. What are the obligations for the employer when an accident at work is discovered? Do they have to start compensating immediately? What is the injured employee entitled to? We will explain how to deal with the statutory insurance company with which the employer is insured for these cases. You will learn what documents to create and to whom to report the accident, as well as what claims and under what conditions the employee will incur in the event of an occupational accident or illness.
We will discuss these and many other issues not only theoretically, but mainly through various examples (we will also draw inspiration from the latest Supreme Court case law). Of course, we will also deal with the participants’ actual questions.
