Company cars – joy or worry?

Employers routinely assign employees a personal car, either directly as a means of doing their job or as a benefit. Very often, employees may also use their assigned car for private purposes.

In practice, however, it is often the case that neither party knows what obligations the employee has and may have in connection with the use of the company car or what the differences are in the employee’s liability for damage caused by the use of the car for business or private purposes, i.e. when and under what conditions the employee will be liable for damage and within what limits. Similarly, employers often do not know what liability for damages they may incur in connection with an employee’s use of a company car, or that a company car cannot be subject to liability for loss of entrusted property. Similar confusion arises if an employer allows an employee to use his or her private car for business purposes.
